Kora Terms & Conditions

1. Introduction

Welcome to the Kora virtual try-on experience (the "Service"), provided by Thesimus Limited ("we," "us," or "our"). By accessing or using the Kora widget or a Kora account, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not agree to these Terms, please do not use the Service.

2. The Service (Nature of AI Visualization)

The Service uses Artificial Intelligence (AI) to generate a digital simulation of products on a photograph you upload. Your photo is used to generate the try-on image; it is not used to identify you, and we do not create face-recognition templates (see our Privacy Policy for details).

Important disclaimer for shoppers:

  • Visualization only. Images generated by Kora are artistic simulations for style reference. They are not photographs of the actual physical product on your body.
  • Fit, scale & texture may vary. The AI may not perfectly replicate the physical dimensions, sizing, draping, or texture of the product.
  • Watches & jewelry. The AI may not accurately reflect precise size or scale on your wrist or finger. Always refer to the product specifications on the retailer's product page.
  • Clothing. The simulation cannot replicate how fabric behaves in motion, its transparency, or how it drapes on specific body shapes, and does not indicate whether a garment runs true to size.
  • Footwear. The visualization shows aesthetic style only — not comfort, width, or fit.
  • No guarantee. We do not guarantee the physical product will look or fit as it does in the AI generation. Do not base purchasing decisions solely on the visualization.

3. Kora Accounts

You may use the Service as a guest or create a free Kora account (via Google sign-in or an email verification code). An account lets you save photos and try-on images and reuse them across participating stores.

  • You are responsible for the accuracy of your account information and for keeping access to your email or Google account secure.
  • Your saved content is personal to you. Do not share your account.
  • You may delete your saved content or your account at any time. We may suspend or terminate accounts that violate these Terms.

4. User Content & License

You retain full ownership of the photos you upload ("User Content"). To provide the Service, you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and process your User Content solely to:

  1. generate your virtual try-on images; and
  2. if you have a Kora account and choose to save content, store that content so you can access and reuse it.

The license under (1) ends when your try-on image has been generated. The license under (2) ends when you delete the saved content or your account.

5. User Conduct

You agree not to upload content that:

  • contains nudity, sexual content, or excessive violence;
  • infringes the intellectual property or privacy rights of any third party (for example, a photo of another person without their consent);
  • is illegal, harmful, or promotes hate speech.

We may block uploads that violate these standards using automated safety filters.

6. Intellectual Property

Our rights: we own all rights, title, and interest in the Kora technology, code, and AI systems used to provide the Service.

Your rights: you own your original photograph. Generated try-on images are licensed to you for personal, non-commercial use (for example, sharing on social media).

7. Disclaimers & Warranties

For users in Australia and South Africa: nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that cannot be excluded by law.

General disclaimer: TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-GENERATED IMAGES WILL BE ERROR-FREE OR ACCURATE.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • we shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service;
  • we are not liable for purchasing decisions made based on the Service;
  • our total liability for any claims arising out of the Service shall not exceed the amount you paid us for the Service (or USD 100 if the Service was free).

9. Indemnification

You agree to indemnify and hold harmless Thesimus Limited and our retail partners from any claims, damages, liabilities, and expenses arising out of:

  • your violation of these Terms;
  • your violation of any third-party right (including privacy or copyright);
  • the content of any photo you upload.

10. Age Restrictions

The Service is not intended for individuals under 16. By using the Service, you represent that you are at least 16 years of age (or the age of majority in your jurisdiction), or that you have permission from a parent or legal guardian.

11. Dispute Resolution & Class Action Waiver (US Users Only)

  • Individual basis: you agree that any dispute arising out of your use of the Service will be resolved on an individual basis, and you waive the right to participate in a class action or class-wide arbitration.
  • Arbitration: for users in the United States, disputes shall be resolved by binding arbitration rather than in court, except for small-claims cases.

12. Severability

If any provision of these Terms is found unenforceable or invalid, that provision will be removed and the remaining Terms will remain in full force.

13. Governing Law

These Terms are governed by the laws of Ireland, without regard to conflict-of-law provisions. Disputes shall be resolved exclusively in the courts of Ireland.
