Kora Terms & Conditions

1. Introduction

Welcome to the Kora Virtual Try-On experience (the "Service"), provided by Thesimus Limited ("we," "us," or "our"). By accessing or using the Kora widget, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not agree to these Terms, please do not use the Kora Virtual Try-On feature.

2. The Service (Nature of AI Visualization)

The Service uses Artificial Intelligence (AI) to generate a digital simulation of products on a user-uploaded photograph.

Important Disclaimer for Shoppers:

  • Visualization Only: The images generated by Kora are artistic simulations for style reference only. They are not photographs of the actual physical product on your body.
  • Fit, Scale & Texture May Vary: While we strive for realism, the AI may not perfectly replicate the physical dimensions, sizing, draping, or texture of the product.
  • Watches & Jewelry: The AI may not accurately reflect the precise millimeter size or scale of the item on your wrist or finger. Always refer to the product specifications (e.g., case diameter, ring size) listed on the retailer’s product page.
  • Clothing (Apparel): The AI simulation cannot replicate how fabric behaves in motion, its transparency, or how it drapes over specific body shapes. It does not indicate whether a garment runs "true to size."
  • Footwear (Shoes): The visualization shows aesthetic style only. It cannot indicate comfort, width, arch support, or how the shoe fits your specific foot shape.
  • No Guarantee: We do not guarantee that the physical product will look or fit exactly as it does in the AI generation. Purchasing decisions should not be based solely on the AI visualization.

3. User Content & License

You retain full ownership of the photos you upload ("User Content"). However, to provide the Service, you grant us a limited license:

The License: By uploading a photo, you grant us a worldwide, royalty-free, non-exclusive, sub-licensable license to use, reproduce, modify, and process your User Content solely for the purpose of generating the Kora virtual try-on visualization during your active session.

Termination of License: This license terminates immediately when the generated image is deleted from our processing memory (which occurs instantly after generation).

4. User Conduct & Representations

You agree that you will not upload content that:

  • Contains nudity, sexual content, or excessive violence.
  • Infringes on the intellectual property or privacy rights of any third party (e.g., uploading a photo of a celebrity or a stranger without their consent).
  • Is illegal, harmful, or promotes hate speech.

We reserve the right to block any upload that violates these standards using automated safety filters.

5. Intellectual Property

Our Rights: We own all rights, title, and interest in the Kora technology, code, and AI models used to provide the Service.

Your Rights: You own your original photograph. The generated output (the composite image) is licensed to you for your personal, non-commercial use (e.g., sharing on social media).

6. Disclaimers & Warranties

For users in Australia and South Africa: Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that cannot be excluded by law (such as the Australian Consumer Law or South African Consumer Protection Act).

General Disclaimer: TO THE FULFLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE AI-GENERATED IMAGES WILL BE ERROR-FREE OR ACCURATE.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.
  • We are not liable for any purchasing decisions made based on the Service (e.g., if a watch or garment purchased based on the visualization does not fit).
  • Our total liability to you for any claims arising out of the Service shall not exceed the amount you paid to us, if any, for using the Service (or $100 USD if the Service was free).

8. Indemnification

You agree to indemnify and hold harmless [ Your Company Name ] and our retail partners (including Daniel Wellington) from any claims, damages, liabilities, and expenses arising out of:

  • Your violation of these Terms;
  • Your violation of any third-party right (including privacy or copyright);
  • The content of any photo you upload.

9. Age Restrictions

The Service is not intended for individuals under the age of 16. By using the Service, you represent that you are at least 16 years of age (or the age of majority in your jurisdiction). If you are a minor, you represent that you have received permission from a parent or legal guardian to use the Service.

10. Dispute Resolution & Class Action Waiver (US Users Only)

  • Individual Basis: You agree that any dispute or claim arising out of your use of the Service will be resolved on an individual basis. You waive your right to participate in a class action lawsuit or class-wide arbitration.
  • Arbitration: For users in the United States, any dispute shall be resolved by binding arbitration rather than in court, except for small claims court cases.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court (e.g., if a judge rules that our liability limit is too low), that specific provision will be removed, but the rest of these Terms will remain in full force and effect.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions.

Dispute Resolution: Any disputes arising from these Terms shall be resolved exclusively in the courts of Ireland.
